Terms and Conditions of Artefact Auctions Ltd. 1. Introduction 1.1 These Terms and Conditions (the "Agreement") govern your participation in any auction ("Auction") conducted by Artefact Auctions Ltd. ("the Auctioneer," "we," or "our"). By registering, bidding, or participating in the Auction, you ("the Bidder," "you," or "your") agree to comply with these Terms and Conditions. 1.2 The Auction is conducted on Artefact Auction’s website and hosted by Biddify Ltd., and these Terms and Conditions apply to all bids made via this platform. 2. Registration 2.1 To participate in the Auction, you must register as a bidder. By completing the registration process, you confirm that you are legally able to enter into binding contracts and are of legal age to participate in an Auction. 2.2 You swear to provide accurate, current, and complete information during the registration process and to promptly update any changes to this information. All registrations must include a valid credit card. 3. Auction Lots 3.1 All items listed in the Auction ("Lots") are offered for sale on an "as is" basis, without warranties or guarantees, either expressed or implied, regarding their condition, authenticity, or quality, except as otherwise explicitly stated. 3.2 All descriptions and images provided are for informational purposes only. The Auctioneer makes no guarantees about the accuracy of the descriptions, images, or details of any Lot. Your registration indemnifies Artefact Auctions Ltd. from any disagreements that may arise as to the accuracy or representation of any Lot. 4. Bidding Process 4.1 By placing a bid on a Lot, you acknowledge that you are committing to buy the Lot at the bid price if you are the highest bidder at the end of the Auction. 4.2 All bids must be placed in the specified increments set by the Auctioneer. The Auctioneer reserves the right to accept or reject any bid. 4.3 Bid Increments Current Bid Value.............Bid Increment $0 - $190...................................$10 $200 - $480..............................$20 $500 - $950..............................$50 $1000 - $4,900........................$100 $5,000 - $14,500.....................$500 $15,000 +.................................$1,000 4.4 Bidding may take place online, in person, or via other means as indicated by the Auctioneer. The Auctioneer will set specific dates and times for each Auction, and these times may be subject to change. 4.5 The Auctioneer may, at its discretion, cancel, suspend, or reschedule an Auction or Lot if necessary. In such cases, the Auctioneer will notify all registered bidders as soon as reasonably possible. 4.6 By registering with Artefact Auctions Ltd., you give permission for the Auctioneer to place a monetary hold on the registered credit card equal to any bid placed, up to and including $2000.00 CAD per bidder. This hold will be removed once the invoice with Artefact Auctions Ltd. has been settled. 5. Auction Ending and Winning Bid 5.1 The Auction for each Lot will end at the scheduled time, unless extended at the Auctioneer’s discretion due to technical issues, a bidding war, or other factors. 5.2 The highest bid at the close of the Auction will be considered the winning bid, subject to any reserve price or conditions outlined in the Auction listing. 5.3 Once a bid is placed, it cannot be retracted. All bids are final and binding. 6. Payment Terms 6.1 If you are the winning bidder, you agree to pay the bid amount, plus any applicable taxes, fees, or commissions, as stated in the Auction listing. 6.2 Payment must be made in full within 3 business days of the Auction closing, unless otherwise agreed upon by the Auctioneer. If payment is not received or settled with the Auction house, Artefact reserves the right to charge the card on file for the full amount of the invoice. 6.3 Accepted payment methods include Visa, Mastercard, cheque, e-transfer, and cash. The Auctioneer reserves the right to refuse any payment method at its discretion. 6.4 If payment is not received within the required timeframe, the Auctioneer reserves the right to cancel the sale and relist the Lot or offer it to another bidder. 7. Fees and Commissions 7.1 The Auctioneer may charge a buyer’s premium or other applicable fees in addition to the bid price. These fees will be disclosed prior to the Auction and are non-refundable. 7.2 The buyer’s premium will be calculated as 17% of the winning bid amount and added to the final price. 7.4 All sales are subject to a Goods and Services Tax of 5%. 8. Delivery and Collection 8.1 The winning bidder is responsible for arranging and paying for the shipping or collection of the Lot, unless otherwise specified in the Auction listing. 8.2 The Auctioneer may provide assistance with shipping arrangements at an additional cost, but the responsibility for delivery lies with the buyer. 8.3 Risk of loss or damage to the Lot transfers to the buyer once payment is received and the Lot is dispatched. 9. Cancellations, Returns, and Disputes 9.1 All sales are final. No cancellations, refunds, or returns are permitted. 9.2 In the case of a dispute or non-delivery of the Lot, the buyer must notify the Auctioneer within 5 days of the Auction closing. 9.3 In the event of any dispute between the buyer and the Auctioneer, both parties agree to first attempt to resolve the matter amicably. If an agreement cannot be reached, the dispute will be resolved in accordance with the Sale of Goods Act (R.S.A. 2000, c. S-2). 10. Liability 10.1 The Auctioneer is not responsible for any loss, damage, or injury to persons or property arising from participation in the Auction or the use of any Lot. 10.2 The Auctioneer does not guarantee the authenticity, condition, or quality of any Lot. The buyer assumes all risks associated with bidding and purchasing Lots. 11. Privacy and Data Protection 11.1 By registering for the Auction, you consent to the collection, use, and disclosure of your personal data in accordance with the Auctioneer’s privacy policy. 12. General Terms 12.1 The Auctioneer reserves the right to amend or update these Terms and Conditions at any time. Any changes will be posted on the Auction platform, and your continued participation in any Auction will constitute acceptance of the revised terms. 12.2 These Terms and Conditions constitute the entire agreement between you and the Auctioneer, superseding any prior agreements or understandings. 13.
